PBGC Updates Forms for New Reportable Event Regulations

The Pension Benefit Guaranty Corporation (PBGC) has updated its reporting forms and instructions (Form 10 and instructions, Form 10-Advance and instructions, and Form 200 and instructions) to reflect the changes in its reportable event rules. Last year, the PBGC issued final regulations that made significant changes to the rules governing exceptions to reportable event reporting. Reportable events are generally plan or plan sponsor events that can affect the financial health of the sponsor or the plan. The new rules and the new forms are effective as follows:

  1. For plans subject to post-event reporting, the new Form 10 must be used for events that occur on or after January 1, 2016.
  2. For plans subject to advance reporting, the new Form 10-Advance must be used for reports due on or after January 1, 2016 (i.e., for events expected to take effect on or after January 31, 2016).
  3. For reporting large, unpaid contributions, the new Form 200 must be used if the date that the aggregate value of missed contributions first exceeds $1 million is on or after January 1, 2016.
