Fair Labor Standards Act Consulting

President Obama tasked the Department of Labor (DOL) with updating the Fair Labor Standards Act (FLSA) regulations in early 2014 to ensure workers are paid a fair day's pay for a fair day's work. The regulations have now been finalized.

The final rule on overtime pay presents unique challenges for higher education institutions:

  • The salaries of staff in certain positions, such as coaching and teaching, could shift those employees from exempt status to non-exempt status.
  • The new salary threshold may have a significant impact on your institution's budget.
  • The changes in the overtime rule may have implications for your job descriptions and reporting structure.
  • The changes may also affect campus culture, career tracks, morale and other institutional dynamics.
